SenatePanel OKs Bill To Avoid Lawsuit On Plastic Bag Bans

A Senate panel has advanced two measures revising state law to get around a lawsuit over bans on plastic bags and disposable products.

The law passed last session prevents cities from banning disposable products and blocks cities from requiring business owners to report energy consumption.

Rep. Warren Petersen sponsored last year's bill and is now sponsoring legislation that splits the provisions into two separate measures.

The lawsuit filed on behalf of Tempe city council member Lauren Kuby claims the law violates a state constitutional provision requiring each bill to have a single subject.

The Senate committee on water and energy passed House Bill 2130 and 2131 passed 4-3 vote Monday.

Sen. Sylvia Allen said in committee environmentalists are just trying to scare people and take their money.
