Kingman Mayor Jen Miles is no longer facing a recall election.
A Mohave County Superior Court judge on Wednesday ruled that proper procedures under Arizona law weren’t followed during the process of signature collection.
An election law specialist attorney filed a lawsuit last week alleging the recall petitions were not attached to a “time-and-date-marked copy” as required and some of the petition signatures were not personally witnessed by the petition circulator.
City spokeswoman Coleen Haines said the court on Wednesday found in favor of Miles, therefore no recall election will be called.
The recall effort began last September for Miles and four city council members who voted to continue the mayor’s mask mandate for Kingman residents to help stop the spread of COVID-19.
Recall leader James Coffman said elected officials should be shown the door for their “abuse of power” in keeping the mask mandate.
Haines said the initial receipt provided by Coffman indicated that he submitted 148 petition sheets with 2,367 unverified signatures.
But after further review, Haines said it was determined the actual number of submitted petitions was 168 sheets with 2,367 unverified signatures.
