Judge Rejects PHX Gym's Attempt To Stay Open Against Governor's Coronavirus Closure Order

A judge has rejected a request by an Arizona health club chain to stop enforcement of Governor Doug Ducey’s shutdown of gyms due to the coronavirus.

Judge Timothy Thomason ruled today the pandemic provided a rational basis for the governor to take such emergency action and that Mountainside Fitness disobeyed the governor’s order for a week by operating its 18 health clubs. CEO Tom Hatten had no immediate comment on the ruling but has previously said he would close his doors if the judge rejected his request. The state Department of Health Services today reported more than 3,600 newly confirmed virus cases. Hospitalizations, use of ventilators and ICU beds in Arizona have also hit alarming new records.
